1. INTRODUCTION
Gidani is licensed under The Lotteries Act, 1997 (Act No 57 of 1997) as Amended to conduct and promote the National Lottery and Constituent Games in
South Africa. These Rules apply to the SportStake Game, which forms part of the National Lottery.
2. DEFINITIONS
The following
words and terms, when used within these Rules, shall have the following
meanings, unless the context clearly indicates otherwise:
Act - Lotteries Act 57 of 1997 as amended.
Board
or Game Board - A Board is a grid of 12 fixture result predictions
denoted as [1]; [X]; [2] where:
- 1 = Home Win
- X = Draw
- 2 = Home Loss (or Away Win)
Teams included in each of the fixtures
are listed in the order of Home Team versus Visiting
Team. As such, the team mentioned first will always be the Home Team.
Where a fixture is played at a neutral venue for whatever reason,
the Home Team will be
the team mentioned first on the fixture list.
A Home Win - When
the Team mentioned first on the fixture list wins a
specified fixture.
A Draw - A
result when two teams finish with the same score in the
specified fixture.
An Away Win - When
the Team mentioned last on the fixture list wins a
specified fixture.
Cancelled Fixture - Any
fixture that is not completed or does not take place
within the scheduled period or is cancelled for any reason.
Claimant - A person who
submits a claim for the SportStake Game prize
within the applicable claim period as stipulated in these Rules
Claim Form - The
printed form issued by Gidani, which a Player must
complete and submit together with a Valid Winning Ticket, in
order to be eligible to claim prizes as specified in these Rules.
Defective Ticket - A
Ticket, which at the time of purchase is damaged, defaced,
illegible or incomplete or which contains the words “void”,
or “not for sale” or similar wording.
Division A - Prize
category set according to the number of matching
selections required.
Entry Coupon - A
preformatted card provided by Gidani bearing twelve
fixtures on which a Player can make his/her wager selection.The SportStake
Game Entry Coupon carries a maximum of
three Game Boards.
Extra Time - A
further period of play added at the end of a fixtures’ normal
time when scores between zcompeting teams are equal.
Fixture - A
soccer event which has been arranged to take place between
two designated teams at a definite place and time.
Fixture List - A
list of twelve future fixtures to be played, making up the
wager selection applicable for a specified soccer event. This
list will be available from retail outlets and other sources,
such as the media, preceding the listed fixtures.
Fixture Results - Fixture outcome
at the end of normal play, or after Extra Time
(if played). Penalty shootouts are not included when determining
fixture outcomes.
Full Cover - A
Multiple Wager with three outcome predictions for a specific
fixture.
Game - Any
Lottery Game operated or promoted by Gidani as part of
the National Lottery.
Half Cover - A
Multiple Wager with two outcome predictions for a specific
fixture.
Match - The correct prediction of
a fixture
Minor - An individual younger than
18 years of age.
Multiple Wager - The
wager option allowing Players to select more than one
utcome per fixture. The maximum number of outcomes per
fixture is three.
Multidraw - Buying
Tickets for future Fixture Lists will not be allowed for
the SportStake Game.
Normal Time - The normal period of
play for a fixture between two competing
teams.
Penalty Shootout - A
tiebreaker decided by each side taking a specified number
of penalty shots after normal and if applicable, extra time.
The result of a penalty shootout is not considered when
determining fixture outcomes for the SportStake Game.
Player - A
member of the public aged 18 years or over who purchases
a National Lottery Ticket.
Players’ ‘HelpLine’ -
The National Lottery Call Centre that offers Customer Service
to Players. This service is available toll free on 0800 777 777.
Playing Public - Members of the public
who are eligible to purchase Tickets.
Regional Office - A National Lottery
Office designated as such by Gidani.
Retailer - Any
person, firm or company authorised by Gidani to sell
Tickets and/or pay Prizes in respect of Valid Winning Tickets.
Retailers’ ‘HelpLine’ -
The National Lottery Call Centre that offers Customer Service
to Retailers. This service is available on 0800 GIDANI.
Retail Outlet - Any authorised premises
(including premises where an
attended vending machine is situated) where tickets in a constituent
lottery are sold to Players.
Selection - A set of fixture outcomes selected
by a Player and printed on the SportStake Game Ticket.
Serial Number - The
unique number assigned by Gidani’s central
computer
and printed on a Ticket which, subject to these Rules,
provides for the verification of the Ticket as a valid winning
Ticket or otherwise. The Serial Number may be in the form of
digits, a bar code or any other form.
The SportStake Game - Brand name
for the Sports Pool Game operated by Gidani on
behalf of the National Lottery.
Terminal - The device, which allows
Tickets to be printed, and winning
Tickets to be validated.
The Minister- Minister of Trade and
Industry.
Ticket - A Ticket for the SportStake
Game issued by a Terminal and
sold by an authorised Retailer in an authorised manner.
Valid Winning Ticket - A
winning Ticket, which meets all of Gidani’s
Ticket validation
requirements as set out, or referred to, in these Rules.
Wager - A Ticket
bought which entitles the Player’s fixture predictions
to be entered in the system and considered for a Prize if the
minimum correct predictions are made.
3. PLAYING THE SPORTSTAKE GAME
3.1 A listing of 12 fixtures will
be published for each fixture list. Teams included in
each of the fixtures are listed in the order of Home Team versus Visiting
Team.
As such, the team mentioned first will always be the Home Team. Provided
that
where a fixture is played at a neutral venue for whatever reason, the
Home
Team will be the team mentioned first on the published fixture list.
3.2 For each fixture, a player must select a Home Win, a Draw; or
an Away Win.
3.3 A Player can select a minimum of one and a maximum of three boards
per coupon.
3.4 A valid wager must consist of a
minimum of twelve selections (i.e., one selection
per fixture).
3.5 A valid multiple wager must consist
of more than one outcome prediction for
one or more of the specified fixtures.
3.6 The minimum price for a wager is R1.00 per board including VAT.
3.7 Each additional multiple wager
outcome selection will cost an additional R1.00
per combination.
3.8 The maximum wager per coupon
is R1 000.00. (An automated notification will
be activated after the Player wager reaches a R250.00 threshold. This
notification
will prompt the Retailer to ask the Player whether the Player wishes
to
proceed with the wager).
3.9 Each entry selection will only be valid for the specified fixture
list.
3.10 There shall be no QuickPick option
in the SportStake Game.
3.11 There shall be no Multidraw option in
the SportStake Game.
3.12 The SportStake fixture results
are finalised after the completion of all the specified
fixtures for the relevant fixture list. These results will be obtained
from an
independent source by Gidani and verified by an Independent Auditor.
3.13 The verified fixture results
are captured in the Gidani Central Computer System,
which will determine the winning wager for that fixture list.
4. TICKET SALES
4.1 Tickets can be purchased at any
outlet that has an active Terminal. Sales for
a specific fixture list will close at least 30 minutes before the scheduled
commencement
of the earliest fixture on that fixture list.
4.2 If a Player wagers an amount
of R250.00 or more, the Terminal will automatically
issue a notification requesting Player permission to continue with
the sale process.
5. CANCELLATION OF A TICKET
5.1 Cancellations
will be permitted after twenty seconds and up to two hours of the
wager being played. Approval must be sought from the National Lottery
Retailers’
‘HelpLine’ to make cancellations after this period.
5.2 Manual cancellations
will only be possible after Retailers’ ‘HelpLine’ approval.
5.3 Cancellations can only be effected on the Terminal where the
wager was played.
5.4 On cancellation of a Ticket,
the Player is entitled to a refund from the Retailer
equal to the retail price of the cancelled Ticket.
6. TICKET VALIDATION REQUIREMENTS
6.1 Before a prize may be paid on
any Ticket, it must be validated according to
Gidani’s validation procedures. Gidani’s decision as to
whether or not the Ticket
is valid shall be final and binding. Without prejudice to the generality
of the
foregoing, Gidani shall be entitled to declare a Ticket invalid, and
accordingly shall not be obliged to pay any prize, if:
- 6.1.1 The Ticket has been cancelled, whether
in accordance with Gidani’s
normal procedure for cancellation or otherwise.
- 6.1.2 The Ticket is
counterfeit, has been forged in whole or in part or fails to
pass Gidani’s security tests.
- 6.1.3 The Ticket is mutilated, altered, unreadable, incomplete
or tampered
with in any manner.
- 6.1.4 The Ticket is not received by Gidani or the Retailer by
the deadline or
within the timescale applicable to the particular Game.
- 6.1.5 The Serial Number of an apparent winning Ticket does not
appear on
Gidani’s list of Serial Numbers of Winning Tickets or a Valid
Winning
Ticket with that Serial Number has been paid previously.
- 6.1.6 The Ticket does
not appear on Gidani’s central computer’s
list of
Tickets sold for entry on the particular day, or the Ticket data
fails to
match the computer record of that Ticket.
- 6.1.7 Any fixture selection on the Ticket is not shown in its
entirety or is no
fully legible.
- 6.1.8 The Ticket has not been issued or sold in an authorised
manner or by
an authorised National Lottery Retailer.
6.2 A Ticket shall be the only valid
proof that an entry was made and a Valid Winning
Ticket shall be the only valid instrument for claiming a prize.
6.3 A Claimant shall be entitled
to claim only the highest prize Division qualified for
by a winning selection and not for any lesser prize category or any
otherwise
unclaimed prize in the particular day or prize pool.
6.4 Gidani reserves the right to
withhold payment of any prize until it is entirely
satisfied as to the validity of any Ticket that the Claimant is bona
fides winner,
and reserves the right to call for proof of identity and capacity to
claim.
6.5 Gidani reserves the right to photograph any Claimant.
7. DISPUTED CLAIMS
If a dispute arises between Gidani
and the owner of a Ticket or Claimant as to whether
a Ticket is a Valid Winning Ticket, and the Ticket prize claimed has
not been paid, Gidani
may solely at its discretion, reimburse the cost of the Ticket or replace
the disputed
Ticket with a Ticket of equivalent sale price for any current SportStake
Game. This shall
be the owner of the Ticket or Claimant’s sole and exclusive remedy,
and such reimbursement
or replacement shall fully discharge Gidani from any liability in respect
of
such dispute.
8. GAME TERMINATION AND PRIZE CLAIM PERIOD
Prizes must be claimed no later than
23:00 on the 365th day after the date of the final
fixture of the game in which the prize was won. Any such prize not
claimed within this
period will be forfeited. If a prize is claimed by post, the Claimant
must post the Winning
Ticket on which the Claimant’s name, Identity number and contact
details appear
(on the back of the Ticket) within the prize claim period. The Ticket
must be posted to
the address shown on the reverse of the Ticket.
9. RESPONSIBILITY FOR TICKETS
9.1 It shall
be the sole responsibility of the Player to verify at the time
of purchase that the details recorded on the Ticket with regard
to Selection(s), number of
Board(s) played or any other detail pertaining to the Player’s
wager, correspond
with those marked on the SportStake Game Entry Coupon or otherwise
specified,
and that a Serial Number and bar code appears on the Ticket.
9.2 Until such time as a name, identity
number or address is placed on the reverse
side of a Ticket, the bearer of a Ticket, which has been issued in
accordance with
the provisions of these Rules, shall be the owner thereof for the purposes
of
these Rules. When a name, identity number or address is entered on
the reverse
side of the Ticket, subject to the provisions of these Rules, the person
whose
name, identity number, or address appears on the Ticket shall be the
owner of
that Ticket for the purposes of these Rules.
9.3 The Player will be responsible for the safe custody of any Ticket.
9.4 Neither Gidani nor any Retailer
will be responsible for loss, theft, mutilation or
destruction of any Ticket or for any errors or omissions in respect
of any data
recorded on any Ticket or for any loss of whatever nature suffered
or incurred by
any person as a result of any event or condition affecting a Ticket.
9.5 The Player is solely responsible
for claiming from a National Lottery Office or an
authorised Retailer, the full value of the prize to which he/she is
entitled.
9.6 The Player’s eligibility
to win a prize is subject to the Ticket validation requirements
set out in these Rules.
10. PURCHASE AND PRIZE RESTRICTIONS
10.1 There shall be no general right
for any person to purchase a Ticket. In particular,
but without limitation, no Ticket may be purchased by or prize paid
to:
- 10.1.1 Any Minor whether acting on his own or on behalf of another
person.
- 10.1.2 Directors of the Gidani Board or Members of the National
Lotteries Board.
- 10.1.3 Such other persons or category of persons
as Gidani and the Minister
may determine from time to time.
10.2 If a prize is paid to a person
in one of the groups set out in Rule 10.1, such prize
shall be repayable by that person to Gidani upon demand.
10.3 Gidani or any Retailer, in its
sole discretion, may refuse to sell Tickets to any
person or persons without giving reasons. This may include circumstances
in
which, in its view, that person or persons, are playing in a manner,
which Gidani
or the Retailer deems to be interfering with other Players reasonable
access to
that Game.
10.4 The SportStake Game entries
may be played manually using the Terminal
manual play keypad. The Terminal shall prompt the user to enter the
number of
boards required.
10.5 Players shall not use or seek
to use facsimiles or copies of the SportStake Game
coupons, or other materials not approved by Gidani as entry mechanisms
for
any Game.
11. DISSEMINATION OF WINNING RESULTS INFORMATION
11.1 The results of each specified
fixture list will be issued by Gidani to the National
Media and may also be published in such or other manner as Gidani
may determine.
The issuing of the SportStake results will also be made available at
Retail
Outlets.
11.2 The following information will be made available:
- 11.2.1 The date of the fixture list.
- 11.2.2 The SportStake results.
- 11.2.3 The amount payable for each correct entry in each prize
Division.
- 11.2.4 The number of winners in each Division.
- 11.2.5 Such other information as Gidani may determine.
11.3 The dissemination and publication
of the SportStake results by telephone, in
the media and at the Retail Outlets is for information purposes only.
Gidani will
not pay a prize based upon information obtained from winning information
telephone lines or any other source other than the official SportStake
results
electronically recorded in Gidani’s Central Computer System.
12. PAYMENT OF PRIZES AND CLAIM FORMS
12.1 All the
SportStake prizes will be paid in accordance with Gidani’s
Prize Payout
Procedures.
12.2 Each prize must be claimed no
later than 365 days from the date of the final
fixture.
12.3 Cash prizes of up to R50, are payable by all Retailers.
12.4 All Retailers have the discretion to pay up to R5 000 in prize
winnings.
12.5 Prize claims between
R5 001-R50 000 are only payable at an Authorised Prize
Payment Centre (addresses are available from any Retailer or via Players’ ‘HelpLine’)
and claimants must complete a Prize Claim Form and provide proof of
identity.
12.6 Prizes over R50 000 can only
be paid in person to the Claimant or a duly authorised
representative at a National Lottery Office after completion of a Claim
Form
and an identity check.
12.7 Gidani reserves the right, at
its discretion, to require the completion of a Claim
Form in any other case.
12.8 A Claim Form must be completed
in the name of only one Claimant of a valid
winning Ticket.
12.9 All Claim Forms shall be completed
and signed by the Claimant or his/her
legally authorised representative.
12.10 Gidani may refuse to make payment on an incomplete Claim Form.
12.11 If a Claimant is
unable to complete a Claim Form due to legal, physical, or other
disability, a legally authorised representative of the Claimant shall
complete and
sign a Claim Form on the Claimant’s behalf.
12.12 The Claim Form must state the
name of the Claimant and/or the authorised
representative and describe the status of the signatory, if not the
Claimant.
Gidani reserves the right to request proof of the legal capacity of
the authorised
representative to claim.
12.13 If the person signing
the Claim Form is a personal representative of the estate of
a deceased Player, that person shall submit with the Claim Form such
documentation
as Gidani shall in its discretion deem sufficient to properly establish
such
representative’s entitlement to receive the relevant prize.
12.14 Payment of the prize to the
person shown on the Claim Form as the Claimant
or his/her duly authorised representative shall fully and effectively
discharge
Gidani, its officers, employees, representatives, contractors and any
person, firm,
company authorised by Gidani to pay the SportStake Game prizes from
any
further liability for payment of that prize.
12.15 A person who signs a Claim
Form shall be deemed to have represented that
he/she is lawfully entitled to claim the Prize, the information contained
therein
is accurate and complete, and shall indemnify Gidani against any claims
with
respect to the Ticket or delivery of the prize because of any misrepresentation.
12.16 In the event of any inconsistency
in the information submitted on the Claim
Form and/or on the Ticket or for any other reason at its complete discretion,
Gidani may investigate and withhold all winnings which may be due to
the
Claimant (or make a payment into court) until such time as the Claimant
satisfies
Gidani that he/she is the proper person to whom the prize should be
paid.
12.17 Neither Gidani nor any Retailer
shall be responsible or liable to any person
claiming an interest of whatever nature in a lost or stolen Ticket
as a result of the
payment of a prize to the bearer of an unsigned Ticket or to the person
purporting
to be the person whose name, identity number or address is entered
on the
reverse of the Ticket, whether or not advice of the loss or theft had
been notified
to Gidani prior to payment of the prize. Without prejudice to the foregoing,
Gidani shall use its best endeavours to carry out and ensure that any
Retailer
or other persons responsible for payment of prizes shall carry out
such identity
checks and other security measures as Gidani shall in its discretion
deem reasonable
and appropriate in relation to payment of any particular prize amount.
12.18 In the event that Gidani, in
its absolute discretion, believes that the bearer of a
Ticket presented for payment or a person whose name, identity number
or address
has been entered on the reverse side of the Ticket or who has completed
a
Claim Form is not the rightful owner thereof or lawfully entitled thereto,
it shall
be entitled to withhold payment of any prize winnings for a period
of up to
365 days after the relevant final fixture pending the outcome of all
appropriate
checks and enquiries.
12.19 Gidani shall not be liable
to make payments of any prize on a Ticket, which it
knows or suspects has been resold or otherwise transferred by way of
trade.
12.20 Gidani shall not be liable
to pay interest on any winnings in respect of any period
during which security or other relevant checks or enquiries are in
process
regarding any Ticket presented for payment by a Claimant, or during
any period
in which a dispute relating to the validity of a Ticket or a claim
has not been
resolved.
12.21 A prize of R50 000
or less may be claimed, entirely at the Claimant’s
risk, by posting
the Winning Ticket together with a completed Claim Form to the National
Lottery at the address shown on the Claim Form. The Ticket shall contain
the
name and address of the Claimant on the reverse side. If a Ticket is
sent to the
National Lottery that does not have a name appearing on the reverse
side of the
Ticket, payment will be made, subject to the provisions of these Rules,
to the
person whose name appears on the Claim Form.
12.22 If a Ticket that does not have
a name, identity number and address is posted to the
National Lottery Office, together with an accompanying covering letter
by a person
who claims a prize, payment will be made subject to the provisions
of these Rules,
to the person whose name appears on the letter in which a claim is
made.
12.23 Gidani will make payment to
a duly authorised representative of a person under
legal or other disability.
12.24 Gidani will pay
such Claimant by cheque or Electronic Funds Transfer (EFT) in
accordance with Gidani’s procedures provided that all the Ticket
validation
requirements referred to in these Rules have been met.
12.25 Gidani may apply to a court
of competent jurisdiction to determine the lawful
payee in any particular case.
12.26 Save as provided above, the right of any person to a prize
shall not be assignable.
12.27 Under no circumstances shall
any prize be payable by way of goods or services
in lieu of cash, cheque, or electronic transfer.
13. GENERAL
13.1 Any person who purchases or
submits a Ticket for validation or who claims a
prize in whatever capacity, agrees to be bound by the provisions
of the Act, any
regulation made there under, the Licence to operate the National Lottery,
and
by the provisions of these Rules as amended from time to time by Gidani
and
approved by the National Lotteries Board.
13.2 Each prize winner is deemed
to acknowledge that if and to the extent that Gidani
is legally obliged to provide a third party with details of any prize
claimed
by or on behalf of, or paid to the prize winner, Gidani shall be entitled
to do so.
13.3 Gidani may amend, modify, or
otherwise change these Rules. Such amendments,
modifications or changes shall be applicable with effect from their
introduction and shall be applicable to prior Games so far as they
relate to claim
and prize payment procedures.
13.4 These Rules, the conditions
and explanations appearing on Tickets and such
other conditions as are established, constitute the contractual rights
and obligations
between Gidani and owners of Tickets and Claimants in respect to the
SportStake Games. In the event of a discrepancy or inconsistency between
the
Rules and the conditions and explanations, appearing on a ticket or
such other
conditions as established by Gidani, these Rules shall prevail.
13.5 Where the context so requires
in these Rules, the neutral gender shall include
the feminine or masculine gender and vice versa and the singular shall
include
the plural and vice versa.
13.6 In the event that any provision
of these Rules, or conditions appearing on a
Ticket or such other conditions as may be established by Gidani, are
determined
by a court of competent jurisdiction to be void or unenforceable, such
determination
shall solely affect such remaining provision and shall not, in itself,
render
void or unenforceable the remaining provisions hereof.
13.7 No member of the Playing Public
nor a Retailer shall enter into any special
agreement for the sale of a Ticket or Tickets outside the method of
play determined
by Gidani and specified in these Rules.
14. LIMITATION OF LIABILITY
14.1 The Retailer is authorised by
Gidani to sell Tickets, to pay prizes in respect of
Valid Winning Tickets and to process Ticket cancellations in relation
to the
SportStake Game in accordance with these Rules and to display and/or
have
available information produced by Gidani in respect of the SportStake
Game.
Save as specified in the written agreement between Gidani and such
a Retailer,
a Retailer is not authorised by Gidani to carry out any other acts
or make any
omissions whatsoever.
14.2 If a Defective Ticket
is purchased it shall be void and Gidani’s
only liability shall
be reimbursement of the cost of purchase.
14.3 If a Ticket purchased
which is cancelled whether in accordance with Gidani’s
normal procedures for cancellation or otherwise, the only liability
of Gidani (or
the Retailer) as the case may be, shall be the reimbursement of the
cost of the
Ticket.
14.4 Neither Gidani nor any Retailer
shall in any circumstances be liable for any loss
of whatever nature, including but without limitation, indirect or consequential
loss, suffered or incurred by any Player, any bearer or owner of a
Ticket, any
Claimant or any other person arising from the withdrawal of any Game
or from
the participation or non-participation of any person in any Game, including
the
loss, for whatever reason, of the chance to participate in such Game.
In particular,
but without prejudice to the generality of the foregoing, neither Gidani
nor
any Retailer shall be liable to any person in the event of force majeure.
14.5 Gidani shall have the right to suspend or
withdraw and/or to suspend the play of any Game from any Terminal
at its absolute discretion at any time on account of:
- 14.5.1 the failure of, or damage to or destruction
of Gidani’s Central Computer System or records, or any part
thereof; or
- 14.5.2 delays, losses, errors or omissions in or
made by the postal or other
delivery service or by the banking system; or
- 14.5.3 any other action or event, which prevents
or hinders the issue of a
valid Ticket, or for the refusal to sell a Ticket to any person
in accordance
with these Rules.
15. WINNING SELECTIONS
15.1 Winner selection is performed
as soon as verified results have been entered into
the Gidani Central Computer System.
15.2 A wager is considered a winning
wager if it achieves the required number of
correct fixture predictions.
15.3 The number of correct fixture
predictions required to win in each Division is as
follows:

15.4 If a fixture on the fixture
list is not played due to it being delayed, abandoned or
cancelled, every prediction for that fixture event is considered a
correct prediction.
15.5 If a fixture commences before
the close of sales as indicated in the Rules, every
prediction for that fixture is considered a correct prediction.
16. THE SPORTSTAKE GAME PRIZE POOLS
16.1 Gidani will pay prizes as defined
in the SportStake Game Rules and will allocate
an appropriate amount to the Prize fund to meet the liabilities for
the payment
of prizes for that fixture list.
16.2 The total prize fund per fixture list will be 50% of total net
sales.
16.3 The prize Divisions will be as follows:

16.4 The first Division will feature
a Jackpot. When there are no winners in Division
One, that prize fund will roll into the next scheduled fixture list
Division One
prize fund.
16.5 Division One Jackpots will roll for a maximum of nine scheduled
fixture lists.
16.6 If the tenth fixture list Jackpot
amount is not won, then the Jackpot amount is
split equally between the Division(s) where there are winners.
16.7 If there are no winners in any
prize Division on the tenth scheduled fixture list,
the applicable prize pool for each Division will roll to corresponding
Divisions
for the next fixture list.
16.8 If there are no winners in Division
Two but there are winners in Division Three,
the Division Two prize fund will be allocated to Division Three.
16.9 If there are no winners in Division Three but there are winners
in Division Two, the Division Three prize fund will be allocated to
Division Two.
16.10 If there are no winners in
both Divisions Two and Three, the applicable prize
pools will roll to corresponding Divisions for the next fixture list.
16.11 If both Divisions Two and Three
do not have winners on the last fixture of the
season, then both prize pools will be added to the Jackpot prize pool.
16.12 If there are no winners for
the Jackpot on the last fixture list of the season, the
prize fund for Division One will be shared equally in Divisions where
there are
winners.
16.13 If there are no winners in
any of the prize Divisions for the last fixture list of the
season, 50% of the prize value will be allocated to the NLDTF and 50%
will be
utilised by Gidani for future National Lottery prizes.
17. REFUNDS IN CERTAIN CIRCUMSTANCES
Refunds will only be permissible
in cases where the SportStake Game Tickets are
cancelled.
18. DECISION OF GIDANI BINDING
Gidani’s decision as to whether
or not a Ticket is a winning Ticket or in respect of any
other matter or dispute arising from the payment or awarding or non-payment
or nonawarding
of prizes shall be final and binding upon all Players and any other
person or
persons having any interest in the matter or dispute. In the event
of a dispute in respect
of a winning Ticket, a Claim form, or the payment or awarding of any
prize, Gidani may
withhold payment of the prize and/or make an equivalent payment into
court until the
dispute has been resolved.
19. LAW
These Rules shall be governed by
and construed in all respects in accordance with the
laws of the Republic of South Africa and the South African Courts
shall have jurisdiction.

22. PAYMENT TO PERSONS UNDER A LEGAL DISABILITY
22.1 Gidani will make payment to
the duly authorised representative of a person
under legal or other disability.
22.2 Gidani may apply to a court
of competent jurisdiction to determine the lawful
payee in any particular case.
22.3 Save as provided above, the
right of any person to a prize drawn shall not be
assignable.
23. PRIZE PAYMENT BY MAIL
23.1 A prize
of R50 000 or less may be claimed, entirely at the Claimant’s
risk, by
posting the winning Ticket together with the Claimants certified ID
and physical
address to the National Lottery at the address shown on the Claim Form.
The
Ticket shall contain the name and address of the Claimant on the reverse
side. If
a Ticket is sent to the National Lottery that does not have a name
appearing on
the reverse side of the Ticket, payment will be made, subject to the
provisions of
these Rules, to the person whose name appears on the Claim Form.
23.2 Gidani will pay such
Claimant by cheque or EFT in accordance with Gidani’s procedures
provided that all the Ticket validation requirements referred to in
these
Rules have been met.
1. INLEIDING
Gidani is gelisensieer ingevolge die Wet op Lotery, 1997 (Wet Nr
57 van 1997) soos
gewysig om die Nasionale Lotery en konstituerende spelle in Suid-Afrika
te bedryf en
te bevorder.
Hierdie reëls is van toepassing op die SportStake-spel, wat
deel van die Nasionale
Lotery uitmaak.
2. WOORDOMSKRYWINGS
Die volgende woorde en terme het, wanneer dit binne hierdie reëls
gebruik word, die
volgende betekenisse, tensy dit uit die samehang anders blyk:
Wet Wet op Loterye 57 van 1997 soos gewysig.
Bord of Spelbord ‘n Bord is ‘n rooster van 12 uitslagvoorspellings
van
wedstryd aangedui as [1]; [X]; [2] waar:
1 = Tuisveld-oorwinning
X = Gelykop-uitslagTrekking
2 = Tuisveld-verloor (of weg-oorwinning)
Spanne wat in elk van die wedstryde ingesluit word, word in die volgorde
van tuisspan
teen besoekende span gelys. As sodanig is die span wat eerste genoem
word altyd die
tuisspan.
Indien ‘n wedstryd om watter rede ook al op ‘n neutrale
veld gespeel word, is die tuisspan
die span wat eerste op die wedstrydlys genoem word.
‘n Tuisveld-oorwinning: Wanneer die span wat eerste op die
wedstrydlys
genoem word, ‘n spesifieke wedstryd wen.
‘n Gelykop-uitslag: ‘n Uitslag wanneer twee spanne in
die gespesifiseerde
wedstryd met dieselfde telling eindig.
‘n Weg-oorwinning: Wanneer die span wat laaste op die wedstrydlys
genoem word, ‘n spesifieke wedstryd wen.
Gekanselleerde Wedstryd Enige wedstryd wat nie
voltooi word nie of wat nie
plaasvind binne die geskeduleerde tydperk nie of
om enige rede gekanselleer word.
Eiser ‘n Persoon wat ‘n eis vir ‘n SportStake-spel-prys
indien binne die toepaslike eistydperk soos deur
hierdie reëls gestipuleer.
Eisvorm Die gedrukte vorm uitgegee deur Gidani wat ‘n
speler moet voltooi en moet indien, tesame met
‘n geldige wenkaartjie, ten einde te kwalifiseer om
pryse te eis soos in hierdie reëls gespesifiseer.
Defektiewe Kaartjie ‘n Kaartjie wat op die tydstip van aankoop,
beskadig,
ontsier, onleesbaar of onvolledig is of wat die
woorde “ongeldig” of “nie te koop nie” of
soortgelyke
bewoording bevat.
Afdeling ‘n Pryskategorie wat gestel word ooreenkomstig die
getal ooreenstemmende keuses wat vereis word.
Inskrywingskoepon ‘n Vooraf geformateerde kaart wat deur Gidani
voorsien
word en waarop die twaalf wedstryde verskyn
waarop ‘n speler sy/haar wedkeuse kan maak. Die
SportStake-spel se inskrywingskoepon bevat ‘n maksimum
van drie spelborde.
Ekstra Tyd ‘n Verdere speeltydperk wat aan die einde van ‘n
wedstryd se normale tyd bygevoeg word wanneer
tellings tussen mededingende spanne gelykop is.
Wedstryd ‘n Sokkergeleentheid wat gereël is om tussen
twee
aangewese spanne op ‘n definitiewe plek en tyd
plaas te vind.
Wedstrydlys ‘n Lys van twaalf toekomstige wedstryde wat
gespeel moet word en wat die weddenskapkeuse
uitmaak wat vir ‘n gespesifiseerde sokkergeleentheid
van toepassing is. Hierdie lys sal voor die gelyste
wedstryde by kleinhandel-afsetpunte en ander
bronne beskikbaar wees, soos die media.
Wedstryduitslae Wedstryduitkoms aan die einde van normale spel,
of na ekstra tyd (indien gespeel). Strafdoeluitkloppe
word nie ingesluit wanneer wedstryduitslae bepaal
word nie.
Volle Dekking ‘n Veelvuldige weddenskap met drie uitslagvoorspellings
vir ‘n spesifieke wedstryd.
Spel Enige loteryspel wat deur Gidani as deel van die
Nasionale Lotery bedryf of bevorder word.
Halfdekking ‘n Veelvuldige weddenskap met twee uitslagvoorspellings
vir ‘n spesifieke wedstryd.
Ooreenstemming Die korrekte voorspelling van ‘n wedstryd.
Minderjarige ‘n Individu wat jonger as 18 jaar oud is.
Veelvuldige Weddenskap Die weddenskapopsie wat spelers toelaat om
meer
as een uitslag per wedstryd te kies. Die maksimum
getal uitslae per wedstryd is drie.
Multitrekking Koop van kaartjies vir toekomstige wedstrydlyste sal
nie vir die SportStake-spel toegelaat word nie.
Normale Tyd Die normale speeltyd vir ‘n wedstryd tussen twee
mededingende spanne.
Strafdoeluitklop ‘n Uitklopstryd wat beslis word deurdat elke
kant ‘n
gespesifiseerde aantal strafskoppe na normale en,
indien toepaslik, ekstra tyd neem. Die uitslag van ‘n
uitklop deur strafdoele word nie in aanmerking geneem
wanneer wedstryduitslae vir die SportStakespel
bepaal word nie.
Speler ‘n Lid van die publiek wat 18 jaar of ouer is en wat ‘n
Nasionale Lotery-kaartjie koop.
Spelers-’Hulplyn’ Die Nasionale Lotery-inbelsentrum wat
kliëntedienste
aan spelers bied. Hierdie diens is tolvry by
0800 777 777 beskikbaar. Spelende Publiek Lede van die publiek wat
kwalifiseer om kaartjies te
koop.
Streekskantoor ‘n Nasionale Lotery-kantoor wat as sodanig deur
Gidani
aangewys is.
Kleinhandelaar Enige persoon, firma of maatskappy wat deur Gidani
gemagtig is om kaartjies te verkoop en/of pryse ten
opsigte van geldige wenkaartjies te betaal.
Kleinhandelaars-’Hulplyn’ Die Nasionale Lotery-inbelsentrum
wat kliëntedienste
aan kleinhandelaars bied. Hierdie diens is by 0800 GIDANI
beskikbaar.
Kleinhandel-afsetpunt Enige gemagtigde perseel (insluitende ‘n
perseel waar ‘n
muntoutomaat onder toesig geleë is) waar kaartjies in ‘n
konstituerende lotery aan spelers verkoop word.
Keuse ‘n Stel wedstryduitslae wat deur ‘n speler gekies
en op
die SportStake-spelkaartjie gedruk is.
Reeksnommer Die unieke nommer wat deur Gidani se sentrale
rekenaar toegeken en op ‘n kaartjie gedruk word wat,
behoudens hierdie reëls, voorsiening maak vir die
verifiëring van die kaartjie as ‘n geldige wenkaartjie,
of
andersins. Die reeksnommer kan in die vorm van syfers,
‘n staafkode of enige ander vorm wees.
Die SportStake-spel Handelsnaam vir die sportpoelspel wat deur Gidani
namens die Nasionale Lotery bedryf word.
Terminaal Die toestel wat kaartjies toelaat om gedruk en die
geldigheid van wenkaartjies om bevestig te word.
Die Minister Minister van Handel en Nywerheid
Kaartjie ‘n Kaartjie vir die SportStake-spel wat deur ‘n
terminaal
uitgereik en deur ‘n gemagtigde kleinhandelaar op
gemagtigde wyse verkoop word.
Geldige Wenkaartjie ‘n Wenkaartjie wat voldoen aan al Gidani
se vereistes
vir geldigheidsbevestiging van kaartjies soos in hierdie
reëls uiteengesit of genoem.
Weddenskap ‘n Kaartjie wat gekoop is en wat die speler se wedstrydvoorspellings
daarop geregtig maak om in die stelsel
ingelees te word en vir ‘n prys in aanmerking te kom indien
die minimum korrekte voorspellings gemaak word.
3. OM DIE SPORTSTAKE-SPEL TE SPEEL
3.1 ‘n Lys van 12 wedstryde sal vir elke wedstrydlys gepubliseer
word. Spanne wat
in elk van die wedstryde ingesluit word, word in die volgorde van tuisspan
teen
besoekende span gelys. Dus sal die span wat eerste genoem word, altyd
die
tuisspan wees, op voorwaarde dat waar ‘n wedstryd om watter rede
ook al op
‘n neutrale veld gespeel word, die tuisspan die span sal wees
wat eerste op die
gepubliseerde wedstrydlys genoem word.
3.2 Vir elke wedstryd moet ‘n speler ‘n tuisveld-oorwinning, ‘n
gelykop-uitslag of ‘n
weg-oorwinning kies.
3.3 ‘n Speler kan ‘n minimum van een en ‘n maksimum
van drie rye per koepon kies.
3.4 ‘n Geldige weddenskap moet uit ‘n minimum van twaalf
keuses bestaan (d.w.s.,
een keuse per wedstryd).
3.5 ‘n Geldige veelvuldige weddenskap moet uit meer as een uitslagvoorspelling
vir
een of meer van die gespesifiseerde wedstryde bestaan.
3.6 Die minimum prys vir ‘n weddenskap is R1.00 per spelry, insluitende
BTW.
3.7 Elke bykomende keuse vir die uitslag van ‘n veelvuldige trekking
sal ‘n bykomende
R1.00 per kombinasie kies.
3.8 Die maksimum weddenskap per koepon is R1 000.00. (‘n Outomatiese
kennisgewing
sal geaktiveer word wanneer die speler se weddenskap die grens
van R250.00 bereik. Hierdie kennisgewing sal aan die kleinhandelaar
sê om die
speler te vra of die speler met die weddenskap wil voortgaan.)
3.9 Elke inskrywingskeuse sal slegs vir die gespesifiseerde wedstrydlys
geldig wees.
3.10 Daar sal geen QuickPick-opsie in die SportStake-spel wees nie.
3.11 Daar sal geen opsie vir veelvuldige trekkings in die SportStake-spel
wees nie.
3.12 Die SportStake-wedstryduitslae word na voltooiing van al die gespesifiseerde
wedstryde vir die betrokke wedstrydlys gefinaliseer. Hierdie uitslae
sal deur Gidani
van ‘n onafhanklike bron verkry en deur ‘n onafhanklike
ouditeur geverifieer word.
3.13 Die geverifieerde wedstryduitslae word in Gidani se sentrale rekenaarstelsel
ingevoer, wat die wenweddenskap vir daardie wedstrydlys sal bepaal.
4. KAARTJIEVERKOPE
4.1 Kaartjies kan by enige afsetpunt verkoop word wat ‘n aktiewe
terminaal het.
Verkope vir ‘n spesifieke wedstrydlys sal minstens 30 minute
voor die geskeduleerde
aanvang van die vroegste wedstryd op daardie wedstrydlys sluit.
4.2 Indien ‘n speler ‘n bedrag van R250.00 of meer wed,
sal die terminaal outomaties
‘n kennisgewing uitreik wat toestemming van die speler versoek
om met die
verkoopsproses voort te gaan.
5. KANSELLASIE VAN ‘N KAARTJIE
5.1 Kansellasies sal toegelaat word na twintig sekondes en tot solank
as twee uur
nadat die weddenskap gemaak is. Na hierdie tydperk moet goedkeuring
om
kansellasies te maak by die Nasionale Lotery se Kleinhandelaars-’Hulplyn’ aangevra
word.
5.2 Kansellasies per hand sal slegs moontlik wees na goedkeuring deur
die Kleinhandelaars-’
Hulplyn’.
5.3 Kansellasies kan slegs gemaak word op die terminaal waar die weddenskap
geplaas is.
5.4 By kansellasie van ‘n kaartjie is die speler geregtig op ‘n
terugbetaling vanaf die
kleinhandelaar wat gelyk is aan die kleinhandelprys van die gekanselleerde
kaartjie.
6. VEREISTES VIR GELDIGHEIDSBEVESTIGING VAN KAARTJIES
6.1 Voordat ‘n prys op enige kaartjie betaal mag word, moet dit
volgens Gidani se
prosedures vir geldigheidbevestiging geldig verklaar word. Gidani se
besluit of ‘n
kaartjie geldig is al dan nie, is finaal en bindend. Sonder om afbreuk
te doen aan
die algemeenheid van voorgenoemde is Gidani daarop geregtig om ‘n
kaartjie
ongeldig te verklaar, en dienooreenkomstig nie verplig te wees om enige
prys te
betaal nie, indien:
6.1.1 Die Kaartjie gekanselleer is, hetsy in ooreenstemming met Gidani
se
normale prosedure vir kansellasie of andersins.
6.1.2 Die kaartjie ‘n vervalsing is, in die geheel of gedeeltelik
vervals is of nie
in Gidani se sekuriteitstoetse slaag nie.
6.1.3 Die kaartjie geskend, verander, onleesbaar, onvolledig of op
enige
wyse mee gepeuter is.
6.1.4 Die kaartjie nie deur Gidani of die kleinhandelaar ontvang word
teen
die sperdatum of binne die tydskaal wat op die spesifieke spel van
toepassing is nie.
6.1.5 Die reeksnommer van ‘n klaarblyklike wenkaartjie nie op
Gidani se
lys van reeksnommers van wenkaartjies verskyn nie of ‘n geldige
wenkaartjie met daardie reeksnommer tevore betaal is.
6.1.6 Die kaartjie nie op Gidani se sentrale rekenaarlys van kaartjies
verskyn
wat vir inskrywing op die spesifieke dag verkoop is nie, of die kaartjiedata
nie met die rekenaarrekord van daardie kaartjie ooreenstem nie.
6.1.7 Enige wedstrydkeuse op die kaartjie nie in die geheel teenwoordig
is
nie of nie ten volle leesbaar is nie.
6.1.8 Die kaartjie nie op ‘n gemagtigde wyse of deur ‘n
gemagtigde Nasionale
Lotery-kleinhandelaar uitgereik of verkoop is nie.
6.2 ‘n Kaartjie die enigste geldige bewys dat ‘n inskrywing
gemaak is, en ‘n geldige
wenkaartjie is die enigste geldige instrument om ‘n prys te eis.
6.3 Die eiser is daarop geregtig om slegs die hoogste prysafdeling
te eis wat vir ‘n
wenkeuse gekwalifiseer het en nie vir enige laer pryskategorie of enige
ander
onopgeëiste prys op die spesifieke dag of in die spesifieke pryspoel
nie.
6.4 Gidani behou die reg voor om betaling van enige prys te weerhou
totdat hy
hom ten volle van die geldigheid van enige kaartjie vergewis het, asook
dat die
eiser ‘n bona fide-wenner is, en behou die reg voor om bewys
van identiteit en
hoedanigheid om te eis te versoek.
6.5 Gidani behou die reg voor om enige eiser te fotografeer.
7. BETWISTE EISE
Indien tussen Gidani en die eienaar van ‘n kaartjie of ‘n
eiser ‘n geskil ontstaan daaroor
of ‘n kaartjie ‘n geldige wenkaartjie is en die kaartjieprys
wat geëis word, nie betaal is
nie, mag Gidani, na sy uitsluitlike goeddunke, die koste van die kaartjie
terugbetaal of
die betwiste kaartjie vervang deur ‘n kaartjie van ekwivalente
verkoopprys vir enige
huidige Sportstake-spel. Dit sal die eienaar van die kaartjie of ‘n
eiser se enigste en uitsluitlike
verhaal wees, en sodanige terugbetaling of vervanging sal Gidani ten
volle van
enige aanspreeklikheid ten opsigte van sodanige geskil onthef.
8. SPELBEËINDIGING EN PRYSEISTYDPERK
Pryse moet geëis word nie later nie as 23:00 op die 365e dag na
die datum van die finale
wedstryd van die spel waarin die prys gewen is. Enige sodanige prys
wat nie binne
hierdie tydperk geëis word nie, word verbeur. Indien ‘n
prys per pos geëis word, moet
die eiser die wenkaartjie, waarop die naam, identiteitsnommer en kontakbesonderhede
(op die agterkant van die kaartjie) van die eiser verskyn, binne die
eistydperk pos.
Die kaartjie moet gepos word aan die adres wat op die keersy van die
kaartjie verskyn. 4. KAARTJIEVERKOPE
4.1 Kaartjies kan by enige afsetpunt verkoop word wat ‘n aktiewe
terminaal het.
Verkope vir ‘n spesifieke wedstrydlys sal minstens 30 minute
voor die geskeduleerde
aanvang van die vroegste wedstryd op daardie wedstrydlys sluit.
4.2 Indien ‘n speler ‘n bedrag van R250.00 of meer wed,

terugbetaling vanaf die
kleinhandelaar wat gelyk is aan die kleinhandelprys van die gekanselleerde
kaartjie.
6. VEREISTES VIR GELDIGHEIDSBEVESTIGING VAN KAARTJIES
6.1 Voordat ‘n prys op enige kaartjie betaal mag word, moet dit
volgens Gidani se
prosedures vir geldigheidbevestiging geldig verklaar word. Gidani se
besluit of ‘n
kaartjie geldig is al dan nie, is finaal en bindend. Sonder om afbreuk
te doen aan
die algemeenheid van voorgenoemde is Gidani daarop geregtig om ‘n
kaartjie
ongeldig te verklaar, en dienooreenkomstig nie verplig te wees om enige
prys te
betaal nie, indien:
6.1.1 Die Kaartjie gekanselleer is, hetsy in ooreenstemming met Gidani
se
normale prosedure vir kansellasie of andersins.
6.1.2 Die kaartjie ‘n vervalsing is, in die geheel of gedeeltelik
vervals is of nie
in Gidani se sekuriteitstoetse slaag nie.
6.1.3 Die kaartjie geskend, verander, onleesbaar, onvolledig of op
enige
wyse mee gepeuter is.
6.1.4 Die kaartjie nie deur Gidani of die kleinhandelaar ontvang word
teen
die sperdatum of binne die tydskaal wat op die spesifieke spel van
toepassing is nie.
6.1.5 Die reeksnommer van ‘n klaarblyklike wenkaartjie nie op
Gidani se
lys van reeksnommers van wenkaartjies verskyn nie of ‘n geldige
wenkaartjie met daardie reeksnommer tevore betaal is.
6.1.6 Die kaartjie nie op Gidani se sentrale rekenaarlys van kaartjies
verskyn
wat vir inskrywing op die spesifieke dag verkoop is nie, of die kaartjiedata
nie met die rekenaarrekord van daardie kaartjie ooreenstem nie.
6.1.7 Enige wedstrydkeuse op die kaartjie nie in die geheel teenwoordig
is
nie of nie ten volle leesbaar is nie.
6.1.8 Die kaartjie nie op ‘n gemagtigde wyse of deur ‘n
gemagtigde Nasionale
Lotery-kleinhandelaar uitgereik of verkoop is nie.
6.2 ‘n Kaartjie die enigste geldige bewys dat ‘n inskrywing
gemaak is, en ‘n geldige
wenkaartjie is die enigste geldige instrument om ‘n prys te eis.
6.3 Die eiser is daarop geregtig om slegs die hoogste prysafdeling
te eis wat vir ‘n
wenkeuse gekwalifiseer het en nie vir enige laer pryskategorie of enige
ander
onopgeëiste prys op die spesifieke dag of in die spesifieke pryspoel
nie.
6.4 Gidani behou die reg voor om betaling van enige prys te weerhou
totdat hy
hom ten volle van die geldigheid van enige kaartjie vergewis het, asook
dat die
eiser ‘n bona fide-wenner is, en behou die reg voor om bewys
van identiteit en
hoedanigheid om te eis te versoek.
6.5 Gidani behou die reg voor om enige eiser te fotografeer.
7. BETWISTE EISE
Indien tussen Gidani en die eienaar van ‘n kaartjie of ‘n
eiser ‘n geskil ontstaan daaroor
of ‘n kaartjie ‘n geldige wenkaartjie is en die kaartjieprys
wat geëis word, nie betaal is
nie, mag Gidani, na sy uitsluitlike goeddunke, die koste van die kaartjie
terugbetaal of
die betwiste kaartjie vervang deur ‘n kaartjie van ekwivalente
verkoopprys vir enige
huidige Sportstake-spel. Dit sal die eienaar van die kaartjie of ‘n
eiser se enigste en uitsluitlike
verhaal wees, en sodanige terugbetaling of vervanging sal Gidani ten
volle van
enige aanspreeklikheid ten opsigte van sodanige geskil onthef.
8. SPELBEËINDIGING EN PRYSEISTYDPERK
Pryse moet geëis word nie later nie as 23:00 op die 365e dag na
die datum van die finale
wedstryd van die spel waarin die prys gewen is. Enige sodanige prys
wat nie binne
hierdie tydperk geëis word nie, word verbeur. Indien ‘n
prys per pos geëis word, moet
die eiser die wenkaartjie, waarop die naam, identiteitsnommer en kontakbesonderhede
(op die agterkant van die kaartjie) van die eiser verskyn, binne die
eistydperk pos.
Die kaartjie moet gepos word aan die adres wat op die keersy van die
kaartjie verskyn. 9. VERANTWOORDELIKHEID VIR KAARTJIES
9.1 Dit is die alleenverantwoordelikheid van die speler om ten tyde
van die aankoop
te verifieer dat die besonderhede wat op die kaartjie aangeteken is
wat betref
die keuse(s), getal spelborde wat gespeel is of enige ander besonderhede
met
betrekking tot die speler se weddenskap ooreenstem met dié wat
op die Sport-
Stake-spel se inskrywingskoepon gemerk of andersins gespesifiseer is
en dat ‘n
reeksnommer en staafkode op die kaartjie verskyn.
9.2 Tot die tydstip wanneer ‘n naam, identiteitsnommer of adres
op die keersy van
‘n kaartjie aangebring word, is die draer van ‘n kaartjie,
wat ooreenkomstig die
bepalings van hierdie reëls uitgereik is, die eienaar daarvan
vir die doeleindes
van hierdie reëls. Wanneer ‘n naam, identiteitsnommer of
adres op die keersy
van die kaartjie aangebring is, behoudens die bepalings van hierdie
reëls, is die
persoon wie se naam, identiteitsnommer of adres op die kaartjie verskyn
die
eienaar van daardie kaartjie vir die doeleindes van hierdie reëls.
9.3 Die speler is verantwoordelik vir die veilige bewaring van enige
kaartjie.
9.4 Nóg Gidani nóg enige kleinhandelaar is verantwoordelik
vir verlies, diefstal,
skending of vernietiging van enige kaartjie of vir enige foute of weglatings
ten
opsigte van enige data wat op enige kaartjie aangeteken is of vir enige
verlies
van watter aard ook al wat enige persone gely of aangegaan het as gevolg
van
enige gebeurtenis of toestand wat ‘n kaartjie affekteer.
9.5 Die speler is alleen daarvoor verantwoordelik om die volle waarde
van die prys
waarop hy/sy geregtig is, van ‘n Nasionale Lotery-kantoor of ‘n
gemagtigde
kleinhandelaar te eis.
9.6 Die speler se kwalifisering om ‘n prys te wen, is onderworpe
aan die vereistes vir
geldigheidsbevestiging van kaartjies soos in hierdie reëls uiteengesit.
10. AANKOOP EN PRYSBEPERKINGS
10.1 Daar is geen algemene reg vir enige persoon om ‘n kaartjie
te koop nie. In die
besonder, maar sonder beperking, mag geen kaartjie gekoop word deur
of prys
uitbetaal word nie aan:
10.1.1 Enige minderjarige, ongeag of hy op sy eie of namens ‘n
ander persoon
optree.
10.1.2 Direkteure van Gidani-direksie of lede van die Nasionale Raad
op
Loterye.
10.1.3 Sodanige ander persoon of kategorie persone as wat Gidani en
die
Minister van tyd tot tyd kan bepaal.
10.2 Indien ‘n prys betaal word aan ‘n persoon in een van
die groepe soos in reël
10.1 uiteengesit, is sodanige prys deur daardie persoon op aanvraag
aan Gidani
terugbetaalbaar.
10.3 Gidani of enige kleinhandelaar mag volgens hulle uitsluitlike
goeddunke weier
om kaartjies aan enige persoon of persone te verkoop sonder om redes
te verstrek.
Dit kan omstandighede insluit waarin, na hul mening, daardie persoon
of
persone op ‘n wyse speel wat Gidani of die kleinhandelaar ag
met ander spelers
se redelike toegang tot daardie spel inmeng.
10.4 Die SportStake-spelinskrywings kan per hand gespeel word deur
van die terminaal
se handspeel-sleutelbord gebruik te maak. Die terminaal sal die gebruiker
vra om die getal spelborde wat verlang word, in te sleutel.
10.5 Spelers mag nie faksimileë gebruik of poog om faksimileë of
kopieë van die
SportStake-koepons of ander materiaal te gebruik wat nie deur Gidani
as inskrywingsmeganismes
vir enige spel goedgekeur is nie.
11. VERSPREIDING VAN WENUITSLAGINLIGTING
11.1 Die uitslae van elke gespesifiseerde wedstrydlys sal deur Gidani
aan die nasionale
media uitgereik word en mag ook gepubliseer word op sodanige ander
wyse as wat Gidani mag bepaal. Die uitgee van die SportStake-uitslae
sal ook by
kleinhandel-afsetpunte beskikbaar gestel word.
11.2 Die volgende inligting sal beskikbaar gestel word:
11.2.1 Die datum van die wedstrydlys.
11.2.2 Die SportStake-uitslae.
11.2.3 Die bedrag betaalbaar vir elke korrekte inskrywing in elke prysafdeling.
11.2.4 Die getal wenners in elke afdeling.
11.2.5 Sodanige ander inligting wat Gidani van tyd tot tyd kan bepaal.
11.3 Die verspreiding en publisering van die SportStake-uitslae per
telefoon, in die
media en by die kleinhandel-afsetpunte is slegs vir inligtingsdoeleindes.
Gidani
sal nie ‘n prys betaal op grond van inligting wat verkry is vanaf
weninligtingtelefoonlyne
of enige ander bron buiten die amptelike SportStake-uitslae wat
elektronies in Gidani se sentrale rekenaarstelsel op rekord geplaas
is nie.
12. BETALINGS VAN PRYSE EN EISVORMS
12.1 Alle die SportStake-pryse sal ooreenkomstig Gidani se prysuitbetalingsprosedures
betaal word.
12.2 Elke prys moet nie later nie as 365 dae vanaf die datum van die
finale wedstryd geëis word.
12.3 Kontantpryse van tot R50 is deur alle kleinhandelaars betaalbaar.
12.4 Alle kleinhandelaars kan na goeddunke tot R5 000 pryswengeld betaal.
12.5 Pryseise van R5 001-R50 000 is slegs betaalbaar by ‘n gemagtigde
prysbetalingsentrum
(adresse is beskikbaar vanaf enige kleinhandelaar of via die Spelers-
’hulplyn’) en eisers moet ‘n pryseisvorm voltooi
en bewys van identiteit lewer.
12.6 Pryse bo R50 000 kan slegs persoonlik aan die eiser of ‘n
behoorlik gemagtigde
verteenwoordiger by ‘n kantoor van die Nasionale Lotery uitbetaal
word na
voltooiing van ‘n eisvorm en ‘n identiteitskontrole.
12.7 Gidani behou die reg voor om na sy goeddunke die voltooiing van ‘n
eisvorm in
enige ander geval te vereis.
12.8 ‘n Eisvorm moet in die naam van slegs een eiser van ‘n
geldige wenkaartjie
voltooi word.
12.9 Alle eisvorms moet voltooi en deur die eiser of sy/haar wettig
gemagtigde verteenwoordiger
ingevul en onderteken word.
12.10 Gidani mag weier om betaling vir ‘n onvolledige eisvorm
te maak.
12.11 Indien ‘n eiser as gevolg van wetlike, fisiese of ander
onvermoë nie in staat is om
‘n eisvorm te voltooi nie, moet ‘n wettig gemagtigde verteenwoordiger
van die
eiser ‘n eisvorm namens die eiser voltooi en onderteken.
12.12 Die eisvorm moet die naam van die eiser en/of die gemagtigde
verteenwoordiger
aangee en die status van die ondertekenaar beskryf, indien dit nie
die eiser
is nie. Gidani behou die reg voor om bewys te versoek van die wetlike
hoedanigheid
van die gemagtigde verteenwoordiger om te eis.
12.13 Indien die persoon wat die eisvorm onderteken ‘n persoonlike
verteenwoordiger
van die boedel van ‘n bestorwe speler is, moet daardie persoon
saam met
die eisvorm sodanige dokumentasie indien as wat Gidani na sy goeddunke
toereikend ag om sodanige verteenwoordiger se geregtigdheid daarop
om die
toepaslike prys te ontvang, behoorlik te bepaal.
12.14 Betaling van die prys aan die persoon wat op die eisvorm as die
eiser of sy/
haar behoorlik gemagtigde verteenwoordiger aangetoon word, sal Gidani,
sy
amptenare, werknemers, verteenwoordigers, kontrakteurs en enige persoon,
firma, maatskappy gemagtig deur Gidani om die SportStake-pryse uit
te betaal
ten volle en effektief onthef van enige verdere aanspreeklikheid vir
betaling van
daardie prys.
12.15 ‘n Persoon wat ‘n eisvorm onderteken, word geag te
kenne te gegee het dat hy/
sy wettig daarop geregtig is om die prys te eis en dat die inligting
daarin vervat
akkuraat en volledig is, en skeld Gidani kwyt teen enige eise ten opsigte
van die
kaartjie of lewering van die prys as gevolg van enige wanvoorstelling.
12.16 In die geval van enige teenstrydigheid in die inligting wat op
die eisvorm en/of
op die kaartjie voorgelê word of om enige ander rede na sy uitsluitlike
goeddunke
mag Gidani ‘n ondersoek doen en alle wengeld weerhou wat aan
die eiser
verskuldig mag wees (of ‘n geregtelike inbetaling maak) tot sodanige
tyd as wat
die eiser Gidani tevrede stel dat hy/sy die behoorlike persoon is aan
wie die prys
betaal moet word.
12.17 Nóg Gidani nóg enige kleinhandelaar is verantwoordelik
of aanspreeklik teenoor
enige persoon wat ‘n belang van watter aard ook al in ‘n
verlore of gesteelde
kaartjie eis as gevolg van die betaling van ‘n prys aan die draer
van ‘n ongetekende
kaartjie of aan die persoon wat voorgee die persoon te wees wie se
naam, identiteitsnommer
of adres op die keersy van die kaartjie ingeskryf is, ongeag of kennis
van die verlies of diefstal voor betaling van die prys aan Gidani gegee
is. Sonder
benadeling van die voorgenoemde moet Gidani die beste pogings aanwend
ter uitvoering van en om te verseker dat enige kleinhandelaar of ander
persone
verantwoordelik vir betaling van pryse sodanige identiteitskontroles
en ander
sekuriteitsmaatreëls uitvoer as wat Gidani na sy goeddunke in
verband met die
betaling van enige spesifieke prysbedrag redelik en toepaslik ag.
12.18 In die geval dat Gidani na sy uitsluitlike goeddunke, oortuig
is dat die draer van
‘n kaartjie wat vir betaling aangebied word of ‘n persoon
wie se naam, identiteitsnommer
of adres op die keersy van die kaartjie ingevul is of wat ‘n
eisvorm
voltooi het nie die regmatige eienaar daarvan of wettig daarop geregtig
is nie, is
hy geregtig om betaling van enige pryswengeld vir ‘n tydperk
van tot 365 dae na
die toepaslike finale wedstryd te weerhou, hangende die uitslag van
alle toepaslike
kontroles en navrae.
12.19 Gidani is nie aanspreeklik om betalings van enige prys op ‘n
kaartjie te maak wat
hy weet of vermoed herverkoop of andersins by wyse van handel oorgedra
is nie.
12.20 Gidani is nie aanspreeklik vir die betaling van rente op enige
wengeld ten
opsigte van enige tydperk waartydens sekuriteits- of ander toepaslike
kontroles
of navrae in proses is betreffende enige kaartjie wat vir betaling
deur ‘n eiser
aangebied is of gedurende enige tydperk waarin ‘n geskil met
betrekking tot die
geldigheid van ‘n kaartjie of ‘n eis nie opgelos is nie.
12.21 ‘n Prys van R50 000 of minder mag, in die geheel op die
eiser se risiko, geëis
word deur die wenkaartjie tesame met ‘n voltooide eisvorm aan
die Nasionale
Lotery te pos by die adres wat op die eisvorm aangetoon word. Die kaartjie
moet die naam en adres van die eiser op die keersy bevat. Indien ‘n
kaartjie wat
nie ‘n naam het wat op die keersy van die kaartjie verskyn nie
aan die Nasionale
Lotery gepos word, sal betaling, behoudens die bepalings van hierdie
reëls,
gemaak word aan die persoon wie se naam op die eisvorm verskyn.
12.22 Indien ‘n kaartjie wat nie ‘n naam, identiteitsnommer
en adres het nie tesame
met ‘n vergesellende dekbrief deur ‘n persoon wat ‘n
prys eis aan die kantoor van
Nasionale Lotery gepos word, sal betaling behoudens die bepalings van
hierdie
reëls gemaak word aan die persoon wie se naam verskyn op die brief
waarin ‘n eis gemaak word.
12.23 Gidani sal betaling aan ‘n behoorlik gemagtigde verteenwoordiger
van ‘n persoon
met ‘n handelings- of ander onbevoegdheid maak.
12.24 Gidani sal sodanige eiser per tjek of elektroniese fondsoordrag
(EFO) ooreenkomstig
Gidani se prosedures betaal, met dien verstande dat daar voldoen
is aan al die vereistes vir geldigheidsbevestiging van kaartjies waarna
in hierdie
reëls verwys word.
12.25 Gidani mag by ‘n hof van bevoegde jurisdiksie aansoek doen
om die wettige
begunstigde in enige spesifieke geval te bepaal.
12.26 Behalwe soos hierbo bepaal, is die reg van ‘n persoon op ‘n
prys nie oordraagbaar
nie.
12.27 Onder geen omstandighede mag enige prys by wyse van goedere of
dienste in
plaas van kontant, ‘n tjek of elektroniese oordrag betaalbaar
wees nie.
13. ALGEMEEN
13.1 Enige persoon wat ‘n kaartjie koop of vir geldigheidsbevestiging
voorlê of wat ‘n
prys in watter hoedanigheid ook al eis, stem daartoe in om gebind te
wees deur
die bepalings van die Wet, enige regulasie wat ingevolge daarvan gemaak
is,
die lisensie om die Nasionale Lotery te bedryf en deur die bepalings
van hierdie
reëls soos van tyd tot tyd deur Gidani gewysig en deur die Nasionale
Raad op
Loterye goedgekeur.
13.2 Daar word geag dat elke pryswenner erken dat indien en in die
mate dat Gidani
wettig daartoe verplig is om ‘n derde party te voorsien van besonderhede
van
enige prys wat deur of namens die pryswenner geëis of aan hom
betaal word,
Gidani daarop geregtig is om dit te doen.
13.3 Gidani mag hierdie reëls wysig, modifiseer of andersins verander.
Sodanige
wysigings, modifikasies of veranderinge is van toepassing met ingang
van die
instelling daarvan en is van toepassing op vorige spelle in soverre
dit op eis- en
prysbetalingsprosedures betrekking het.
13.4 Hierdie reëls, die voorwaardes en verduidelikings wat op
kaartjies verskyn en
sodanige ander voorwaardes as wat daargestel is, maak die kontraktuele
regte
en verpligtinge tussen Gidani en eienaars van kaartjies en eisers ten
opsigte van
die SportStake-spel uit. In die geval van ‘n teenstrydigheid
of inkonsekwentheid
tussen die reëls en die voorwaardes en verduidelikings wat op ‘n
kaartjie verskyn
of sodanige ander voorwaardes wat deur Gidani daargestel word, geniet
hierdie
reëls voorrang.
13.5 Indien die konteks in hierdie reëls aldus vereis, sluit die
vroulike die manlike
geslag in, en omgekeerd, en sluit die enkelvoud die meervoud in, en
omgekeerd.
13.6 In die geval dat enige bepaling van hierdie reëls of voorwaardes
wat op ‘n
kaartjie verskyn of sodanige ander voorwaardes wat deur Gidani daargestel
kan
word deur ‘n hof met bevoegde jurisdiksie as ongeldig of onafdwingbaar
bevind
word, affekteer sodanige bevinding slegs sodanige bepaling en maak
dit nie die
oorblywende bepalings hiervan op sigself ongeldig of onafdwingbaar
nie.
13.7 Geen lid van die spelende publiek of ‘n kleinhandelaar mag
enige spesiale ooreenkoms
aangaan vir die verkoop van ‘n kaartjie of kaartjies buite die
speelmetode
wat deur Gidani bepaal en in hierdie reëls gespesifiseer word
nie.
14. BEPERKING VAN AANSPREEKLIKHEID
14.1 Die kleinhandelaar is deur Gidani gemagtig om kaartjies te verkoop,
om pryse
ten opsigte van geldige wenkaartjies te betaal en om kaartjiekansellasies
met
betrekking tot die SportStake-spel in ooreenstemming met hierdie reëls
te
verwerk en/of om inligting wat deur Gidani ten opsigte van die SportStakespel
geproduseer word, te vertoon en/of beskikbaar te hê. Behalwe
soos in die
skriftelike ooreenkoms tussen Gidani en ‘n kleinhandelaar gespesifiseer
word, is
‘n kleinhandelaar nie deur Gidani gemagtig om enige ander handelinge
of enige
versuim hoegenaamd te verrig nie.
14.2 Indien ‘n defektiewe kaartjie gekoop word, is dit ongeldig
en is Gidani se enigste
aanspreeklikheid die vergoeding van die aankoopkoste.
14.3 Indien ‘n kaartjie wat aangekoop is, gekanselleer word,
hetsy ooreenkomstig Gidani
se normale prosedures vir kansellasie of andersins, is die aanspreeklikheid
van Gidani (of die kleinhandelaar), na gelang van die geval, die vergoeding
van
die koste van die kaartjie.
14.4 Nóg ‘n Gidani nóg enige kleinhandelaar is
in enige omstandighede aanspreeklik
vir enige verlies van watter aard ook al, insluitende maar sonder beperking,
onregstreekse of gevolglike verlies wat deur enige speler, enige draer
of eienaar
van ‘n kaartjie, enige eiser of enige ander persoon gely of aangegaan
word,
voortspruitend uit die onttrekking van enige spel of uit die deelname
of niedeelname
van enige persoon aan enige spel, insluitende die verlies, om watter
rede ook al, van die kans om aan sodanige spel deel te neem. In die
besonder,
maar sonder om afbreuk te doen aan die algemeenheid van die voorgenoemde,
is nóg Gidani nóg enige kleinhandelaar teenoor enige
persoon aanspreeklik in
die geval van force majeure.
14.5 Gidani het die reg om die speel van enige spel vanaf enige terminaal
volgens sy
uitsluitlike goeddunke te eniger tyd op te skort of te onttrek na aanleiding
van:
14.5.1 die faling van of skade aan of vernietiging van Gidani se sentrale
rekenaarstelsel of rekords, of enige deel daarvan; of
14.5.2 vertragings, verliese, foute of versuime in of begaan deur die
pos- of
ander afleweringsdiens of deur die bankstelsel; of 14.5.3 enige ander
optrede of gebeurtenis wat die uitreiking van ‘n geldige
kaartjie voorkom of belemmer, of vir die weiering om ‘n kaartjie
aan
enige persoon ooreenkomstig hierdie reëls te verkoop.
15. WENKEUSES
15.1 Wennerselektering word gedoen sodra geverifieerde resultate in
Gidani se sentrale
rekenaar ingesleutel is.
15.2 ‘n Weddenskap word as ‘n wenweddenskap beskou indien
dit die vereiste getal
korrekte wedstrydvoorspellings behaal.
15.3 Die getal korrekte wedstrydvoorspellings wat nodig is om in elke
afdeling te
wen, is soos volg:

15.4 Indien ‘n wedstryd op die wedstrydlys nie gespeel word nie
omdat dit uitgestel,
afgestel of gekanselleer is, word alle voorspellings vir daardie wedstryd
as ‘n korrekte
voorspelling beskou.
15.5 Indien ‘n wedstryd begin voor die sluiting van verkope soos
in die reëls aangedui,
word alle voorspellings vir daardie wedstryd as ‘n korrekte voorspelling
beskou.
16. DIE SPORTSTAKE-SPEL SE PRYSPOELE
16.1 Gidani sal pryse betaal soos in die SportStake-spelreëls
omskryf en sal ‘n toepaslike
bedrag aan die prysfonds toedeel om die verpligtinge vir die betaling
van
pryse vir daardie wedstrydlys na te kom.
16.2 Die totale prysfonds per wedstrydlys sal 50% van totale netto
verkope wees.
16.3 Die prysafdelings is soos volg:

16.4 Die eerste afdeling sal ‘n boerpot hê. Indien daar
geen wenners in Afdeling Een is
nie, sal daardie prysfonds oorrol na die volgende geskeduleerde wedstrydlys

Afdeling Een-prysfonds.
16.5 Afdeling Een-boerpotte sal vir ‘n maksimum van nege geskeduleerde
wedstrydlyste
oorrol.
16.6 Indien die tiende wedstrydlys se boerpotbedrag nie gewen word
nie, sal die boerpotbedrag
gelykop verdeel word tussen die afdeling(s) waar daar wenners is.
16.7 Indien daar geen wenners in enige afdeling op die tiende geskeduleerde
wedstrydlys is nie, sal die betrokke pryspoel vir elke afdeling na
die ooreenstemmende
afdelings vir die volgende wedstrydlys oorrol.
16.8 Indien daar geen wenners in Afdeling Twee is nie maar daar wenners
in Afdeling
Drie is, sal die Afdeling Twee-prysfonds aan Afdeling Drie toegedeel
word
16.9 Indien daar geen wenners in Afdeling Drie is nie, maar daar is
wenners in Afdeling
Twee, sal die Afdeling Drie-prysfonds aan Afdeling Twee toegedeel word
16.10 Indien daar geen wenners in Afdeling Twee sowel as Drie is nie,
sal die betrokke
pryspoele na die ooreenstemmende afdelings vir die volgende wedstrydlys
oorrol.
16.11 Indien beide Afdeling Twee en Drie nie wenners vir die laaste
wedstryd van die
seisoen het nie, sal beide pryspoele by die boerpotpryspoel gevoeg
word.
16.12 Indien daar geen wenners vir die boerpot op die laaste wedstrydlys
van die seisoen
is nie, sal die prysfonds vir Afdeling Een gelykop verdeel word in
afdelings
waar daar wenners is.
16.13 Indien daar geen wenners in enige van die prysafdelings vir die
laaste wedstrydlys
van die seisoen is nie, sal 50% van die pryswaarde aan die NLDTF toegedeel
word en 50% sal deur Gidani vir toekomstige Nasionale Lotery-pryse
benut
word.
17. TERUGBETALINGS IN SEKERE OMSTANDIGHEDE
Terugbetalings sal slegs toelaatbaar wees in gevalle waar kaartjies
van die SportStakespel
gekanselleer word.
18. BESLUIT VAN GIDANI BINDEND
Gidani se besluit daaroor of ‘n kaartjie ‘n wenkaartjie
is al dan nie of ten opsigte van
enige ander aangeleentheid of geskil voortspruitend uit die betaling
of toekenning of
nie-betaling of nie-toekenning van pryse is finaal en bindend vir alle
spelers en enige
ander persoon of persone wat enige belang in die aangeleentheid of
geskil het. In die
geval van ‘n geskil ten opsigte van ‘n wenkaartjie, ‘n
eisvorm of die betaling of toekenning
van enige prys, mag Gidani betaling van die prys weerhou en/of ‘n
ekwivalente
geregtelike betaling maak totdat die geskil opgelos is. 19. WET
Hierdie reëls word bereël deur en in alle opsigte vertolk
in ooreenstemming met die
wette van die Republiek van Suid-Afrika en die Suid-Afrikaanse howe
sal jurisdiksie hê.
20. ANDER TALE
Die SportStake-spelreëls kan in ander tale op versoek verkry word
by die Nasionale
Lotery, Privaatsak X130, Halfweghuis, Midrand, 1685 of deur die Spelers-’Hulplyn’ by
0800 777 777 (tolvry) tussen 06:00 en 23:00 daagliks te skakel of deur ‘n
afskrif af te laai
vanaf die webwerf www.gidani.co.za.
21. GEBRUIKSKODE VIR DEELNEMERS
Die Gebruikskode vir Deelnemers kan op versoek verkry word by die Nasionale
Lotery,
Privaatsak X130, Halfweghuis, Midrand, 1685 of deur die Spelers-’Hulplyn’ by
0800 777 777 (tolvry) tussen 06:00 en 23:00 daagliks te skakel of deur ‘n
afskrif af te laai
vanaf die webwerf www.gidani.co.za.
22. BETALING AAN PERSONE MET ‘N HANDELINGSONBEVOEGDHEID
22.1 Gidani sal betaling aan die behoorlik gemagtigde verteenwoordiger
van ‘n persoon
met ‘n handelings- of ander onbevoegdheid maak.
22.2 Gidani mag by ‘n hof van bevoegde jurisdiksie aansoek doen
om die wettige
begunstigde in enige spesifieke geval te bepaal.
